These Terms of Service ("Terms") govern your access to and use of the website getdaze.com and the Pokemon card sourcing services provided by ゲットだぜ！ ("we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Service Description

ゲットだぜ！ provides a premium Pokemon card sourcing service based in Tokyo, Japan. Our services include:

  • Card Sourcing: We locate and procure specific Pokemon cards from the Japanese market on behalf of our clients, including rare, vintage, and limited-edition cards.
  • Condition Verification: All cards we source are verified through detailed photos and videos shared via WhatsApp, allowing you to confirm condition and details before purchase.
  • In-Person Handoff: We arrange in-person handoff at a designated location in Tokyo, or a mutually agreed meeting point.
  • Market Consultation: We provide expert guidance on the Japanese Pokemon card market, including pricing, trends, and investment potential.

ゲットだぜ！ acts as a sourcing agent on your behalf. We do not guarantee the availability of any specific card, and all sourcing requests are fulfilled on a best-effort basis subject to market availability.

2. Eligibility

To use our services, you must:

  • Be at least 18 years of age or the age of legal majority in your jurisdiction.
  • Have the legal capacity to enter into binding contracts.
  • Provide accurate, current, and complete information as required during registration and order placement.
  • Comply with all applicable laws and regulations regarding the purchase of collectible goods.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if we believe any of these conditions are not met.

3. Account Registration

Certain features of our services may require you to create an account. When you register, you agree to:

  • Provide truthful, accurate, and complete registration information.
  • Maintain and promptly update your account information to keep it current.
  • Maintain the security and confidentiality of your account credentials.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

4. Orders and Payment Terms

4.1 Sourcing Requests

When you submit a sourcing request, you authorize ゲットだぜ！ to search for and procure the specified card(s) on your behalf. A sourcing request does not constitute a binding purchase until we confirm availability and you approve the quoted price.

4.2 Pricing

Prices for sourced cards are determined based on current Japanese market conditions at the time of procurement. Prices displayed on the website are indicative, reflect the market and exchange rate at listing time (including the 40% service fee), and may be slightly higher or lower in practice. The binding price is the quote presented by us and agreed by you on WhatsApp. All prices are denominated in Japanese Yen (JPY); foreign-currency figures are indicative conversions.

4.3 Payment Methods

We accept the following payment methods:

  • Bank transfer (domestic JPY) — for customers in Japan
  • Wise — for overseas customers (Wise only; international bank wires / SWIFT transfers cannot be accepted)

We do not accept cash, credit cards, PayPal, or cryptocurrency.

4.4 Payment Terms

Upon order confirmation, the customer pays 120% of the source price in advance (the source price plus a non-refundable engagement fee of 20%, which counts toward the 40% service fee). Once the card is secured, the customer pays the remaining balance (actual source price × 140% minus the amount already paid) by transfer; receipt of the balance concludes the contract and the in-person handoff is scheduled. No payment takes place at handoff. Failure to complete payment within 7 business days of invoice issuance may result in order cancellation.

4.5 Currency and Taxes

All quoted prices are exclusive of applicable taxes and levies. The buyer is solely responsible for any such charges.

5. Handoff and Delivery

5.1 Handoff Method

All cards are delivered via in-person handoff at a designated location in Tokyo, or a mutually agreed meeting point. We do not offer international shipping.

5.2 Delivery Times

The typical timeframe from sourcing request to handoff is 1–3 weeks, depending on card availability and scheduling. Exact timing will be coordinated via WhatsApp.

5.3 Risk of Loss

Risk of loss transfers to the buyer upon completion of the in-person handoff. The buyer is responsible for inspecting the card(s) at the time of handoff.

6. Returns and Refunds

6.1 Quality Guarantee

All cards sourced by ゲットだぜ！ come with our quality guarantee. If a card is found to be materially misrepresented within 30 days of handoff, we will provide a full refund.

6.2 Condition Discrepancies

If the condition of a received card materially differs from the description provided at the time of purchase, you must notify us within 7 days of handoff with photographic evidence. We will review the claim and, at our discretion, offer a partial refund, exchange, or full refund with return of the card at our expense.

6.3 Non-Returnable Items

The following items are not eligible for return or refund:

  • Cards that have been tampered with, altered, or damaged after handoff.
  • Cards that have been altered or submitted to third-party services after handoff.
  • Custom sourcing requests where the card matches the agreed-upon specifications.
  • Sourcing fees and service charges once the card has been procured.

6.4 Refund Processing

Approved refunds will be processed within 14 business days of receiving the returned card (if applicable). Refunds will be issued to the original payment method.

7. Card Condition

We provide condition descriptions for all cards based on our professional assessment, accompanied by detailed photos and videos shared via WhatsApp. Condition descriptions (e.g., Near Mint, Excellent, Good) are based on industry-standard criteria. However, card condition assessment involves subjective judgment, and minor variations in condition evaluation may occur. Such variations do not constitute grounds for a return or refund.

8. Intellectual Property

All content on the ゲットだぜ！ website, including but not limited to text, graphics, logos, images, software, and design elements, is the property of ゲットだぜ！ or its licensors and is protected by Japanese and international copyright, trademark, and intellectual property laws. You may not:

  • Reproduce, distribute, or publicly display any content from our website without prior written consent.
  • Use our trademarks, service marks, or logos without authorization.
  • Modify, create derivative works from, or reverse-engineer any part of our website or services.
  • Use automated systems (bots, scrapers, etc.) to access our website or collect data without permission.

Pokemon is a trademark of Nintendo/Creatures Inc./GAME FREAK Inc. ゲットだぜ！ is not affiliated with, endorsed by, or sponsored by The Pokemon Company or its affiliates.

9. Disclaimers

  • Market Value: The value of Pokemon cards can fluctuate significantly. ゲットだぜ！ makes no representations or warranties regarding the future value, investment potential, or appreciation of any card.
  • Availability: We do not guarantee that any specific card can be sourced. Rare and vintage cards are subject to limited market availability.
  • Third-Party Services: We are not responsible for the actions, policies, or performance of third-party services including payment processors.
  • Website Availability: We do not warrant that our website will be available at all times or free from errors, viruses, or interruptions.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • ゲットだぜ！'s total liability for any claim arising from or related to these Terms or our services shall not exceed the total amount paid by you for the specific transaction giving rise to the claim.
  • In no event shall ゲットだぜ！ be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of opportunity, or damage to reputation, regardless of whether such damages were foreseeable or whether we were advised of the possibility of such damages.
  • ゲットだぜ！ shall not be liable for any loss or damage arising from events beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, or disruptions to financial systems.

11. Indemnification

You agree to indemnify, defend, and hold harmless ゲットだぜ！, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of our services, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

13. Dispute Resolution

13.1 Informal Resolution

In the event of any dispute, claim, or controversy arising from or related to these Terms or our services, we encourage you to first contact us directly to seek an informal resolution. We will make reasonable efforts to resolve the matter within 30 days.

13.2 Arbitration

If informal resolution is unsuccessful, any dispute shall be finally resolved by arbitration administered by the Japan Commercial Arbitration Association (JCAA) in Tokyo, Japan. The arbitration shall be conducted in English (or Japanese, if both parties agree). The arbitral award shall be final and binding on both parties.

13.3 Jurisdiction

For any disputes not subject to arbitration, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms on our website with a revised "Last Updated" date. Your continued use of our services after any modification constitutes your acceptance of the updated Terms. We will make reasonable efforts to notify registered users of material changes via email.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published on our website, constitute the entire agreement between you and ゲットだぜ！ concerning the use of our services and supersede all prior or contemporaneous agreements, representations, or understandings.
